SCOPE

This Privacy Policy applies to “personal information” (also known as “personal data” or “personally identifiable information”, depending upon your jurisdiction, and with each term as more particularly defined and limited by applicable privacy laws) collected via our websites, as well as other websites operated on our domain or operated by or on behalf of us, such as internal hiring and application portals; our software; our mobile applications, including, without limitation, Booking Union Carrier Dashboard, Booking Union Trax, and O-T-G “On the Go” (as applicable and as accessible to our employees); our internal employee website, The Hub, and other internal communication services; and our other online offerings, which are accessible by computer, tablets, consoles, mobile phones, and other electronic devices and exclusively link this Privacy Policy and our TERMS OF USE (collectively, the “Booking Union Site(s)”), and your access to and use of the Booking Union Sites.


In addition, this Privacy Policy describes: (i) Booking Union’s collection, use, disclosure and processing of personal information obtained through the Booking Union Sites and by means other than through the Booking Union Sites; and (ii) our terms regarding certain communications via text and sms messaging as set forth in the section below titled “TERMS FOR TEXT/SMS MESSAGING TO MOTOR CARRIERS AND POTENTIAL EMPLOYEES/JOB APPLICANTS”.


Please read this Privacy Policy carefully before using any of the Booking Union Sites, as this Privacy Policy and our TERMS OF USE, which are incorporated herein by this reference, govern your access to and use of the Booking Union Sites. The Booking Union Sites are available for your use on the condition that you agree to this Privacy Policy and our TERMS OF USE. If you do not agree to this Privacy Policy and our TERMS OF USE, do not access or use the Booking Union Sites. By accessing or using any of the Booking Union Sites, or by providing your personal information or other information to us, you and the entity you are representing (“you” or “your”) signify your consent to Booking Union’s collection, use, disclosure and processing of personal information in accordance with this Privacy Policy and your agreement to be bound by this Privacy Policy and our TERMS OF USE.


THIRD-PARTY WEBSITES

Please note that a few functions for Booking Union may be administered through third-party sites. Although Booking Union can access certain functions and/or information collected via those websites for purposes such as employment, recruitment, hiring, reference checks, carrier and customer onboarding and related information collection, etc., each of these websites is subject to the applicable third parties' own privacy policy, cookies policy and terms of use, unless our Privacy Policy and TERMS OF USE are exclusively linked on the third-party website or otherwise expressly stated.


In addition, the Booking Union Sites may contain links to other websites operated by unrelated third parties. Booking Union is not responsible for the privacy practices of third-party websites. Booking Union encourages you to be aware of this when you leave the Booking Union Sites and to read the privacy policies of every website that collects personally identifiable information from you. This Privacy Policy applies only to the Booking Union Sites and Booking Union's collection, use, disclosure and processing of personal information.


ONLINE PAYMENT PROCESSING

We use an external service for processing online and in-app payments made through the Booking Union Sites, and related services. If you wish to pay online or in-app through the Booking Union Sites, the provider may collect the personal information you provide, such as payment and other identifying information. The provider uses this information to operate and improve the services it provides to us and others, including for fraud detection, harm and loss prevention, authentication, analytics related to the performance of its services, and to comply with applicable legal requirements. The processing of this information will be subject to the provider's privacy policy. We may change our payment processor(s) at any time with or without notice to you, and we will update this Privacy Policy accordingly if such change occurs.


WHAT PERSONAL INFORMATION DOES BOOKING UNION COLLECT?

You do not have to provide any personal information to browse the publicly available pages of the Booking Union Sites; however, to access or use certain features of the Booking Union Sites or to obtain certain of our services, products or offerings (and also for our service providers, in connection with your provision of services), you may be required to provide certain personal information.


We may collect personal information from you in a variety of ways, including, but not limited to, when you:


  • Register to receive or provide any services, products or offerings

  • Complete an employment application

  • Fill out forms or fields on a Booking Union Site

  • Communicate with us through the Booking Union Sites or by email, mail, text/SMS, telephone, facsimile, interactive chat modules or other electronic means

  • Submit applications or other documents to us

  • Process payments

  • Participate in any of our promotions, contests, events, surveys, webinars, chats, requests for suggestions, or customer support conversations

We also may collect personal information from third parties such as: our service providers; parties that use or receive our services, products or offerings; shippers, consignees and other parties related to a shipment; others whom you instruct to interact with us on your behalf; other third-party sources that are lawfully entitled to provide your personal information; and publicly available information and sources.


PERSONAL INFORMATION BOOKING UNION COLLECTS

We may collect, and in the preceding 12 months may have collected, the following categories of personal information:


  • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, social media identifier, push notification token, Internet Protocol address, email address, account name, social security number, driver's license number, passport number, or other similar identifiers.

  • Shipment-related information such as origin and destination locations, shipment status and location (including precise geolocation, as applicable), contact information of shipper, consignee, party identified for notifications, carriers and/or other parties, individual that signs for the delivery of cargo, and other information pertaining to the provision of logistics services.

  • Financial information such as information used for making, receiving or otherwise processing payments (e.g., bank account number, credit or debit card number or similar information).

  • Characteristics of protected classifications under U.S. federal (and California) law such as citizenship, military or veteran status, gender, disability.

  • Commercial information such as records of services or products purchased.

  • Internet or other electronic network activity information such as browsing history, search history, and information regarding a consumer's interaction with an internet website, application, or advertisement.

  • Geolocation data such as geolocation data derived from your IP address, geolocation data (including precise geolocation) from your mobile device if you use certain location-based features of our mobile apps.

  • Sensory data such as audio, electronic, visual or similar sensory information.

  • Professional or employment-related information such as current or past job history and business contact information.

  • Non-public education information such as education records directly maintained by an educational institution or party acting on its behalf.

  • Inferences drawn from any other personal information to create a profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities and/or aptitudes.

  • Other personal information as defined by applicable law, including, without limitation, as defined by Cal. Civ. Code Section 1798.80(a), such as signature, telephone number, insurance policy number.

  • Sensitive personal information (as defined by the California Consumer Privacy Act of 2018, as amended from time to time ("CCPA")) such as: government identifiers; complete account access credentials; precise geolocation data; racial or ethnic origin, citizenship or immigration information; or content of mail, email or text messages unless Booking Union is the intended recipient.


Automatic Information Collection

Booking Union may collect information about you automatically when you visit a Booking Union Site, communicate through a Booking Union Site, or use any Booking Union Site, such as:


  • System and Device Information: We may automatically receive certain information from your browser or mobile device, such as your browser type, the operating system of your device, the equipment you use to access the Booking Union Site(s), the unique identifier of your mobile device and other online identifiers.

  • IP Address: We may also receive your IP address and the name of the internet service provider ("ISP") or your mobile carrier.

  • Browsing Information: We may collect the URL of the site from which you came and the URL of the site you visit when leaving a Booking Union Site, and your activities on the Booking Union Site, such as web pages you view and how you interact with those webpages.

  • Location: We may collect, depending on your device's settings, location data and other types of information sent from third party services or GPS-enabled devices.

  • Site Usage: As you use the Booking Union Sites, we may also automatically collect information about such usage and your actions on the Booking Union Sites, such as pages you viewed, access times, and how long you spend on a page ("Site Usage Information").

  • Product Interaction Data and Diagnostics Data: We may collect information regarding your interactions with our mobile applications, websites and other Booking Union Sites, as well as crash data, performance data, and other diagnostics data.


HOW DOES BOOKING UNION USE PERSONAL INFORMATION?

Booking Union may use the personal information collected for one or more business purposes, depending upon how you interact with us, including, without limitation:


  • To provide support and improve customer service: We may use personal information to provide you with support and to respond to your inquiries, including to investigate and address concerns and monitor our responses and help more effectively respond to your inquiries, questions, service requests and support needs.

  • To personalize user experience: We may use personal information to provide you with a personalized experience when you use the Booking Union Sites.

  • To analyze and improve the Booking Union Sites and our services, products and offerings: We continually strive to improve the Booking Union Sites and our services, products and offerings.

  • To provide the Booking Union Sites, to provide services, products or offerings, process transactions and fulfill or meet the purpose for which you provided the information.

  • Pertaining to the provision of logistics services: We may use personal information in connection with the performance of logistics services and related functions.

  • To develop new features and functions for the Booking Union Sites, develop new services, products or offerings, and optimize our business operations.

  • For marketing: We may use personal information to conduct and enhance our networking, marketing, social, and recruiting activities, and for other similar business purposes.

  • For security, risk management, and protection: We may use personal information to verify or enhance the security of the Booking Union Sites, our networks, systems, other technology assets and businesses.

  • For compliance and legal reasons: We may use personal information for compliance and legal reasons such as: monitoring and enforcing compliance with relevant contractual obligations, industry standards, company policies and legal and regulatory requirements.

HOW DOES BOOKING UNION DISCLOSE PERSONAL INFORMATION?

Booking Union does not sell your personal information to third parties for monetary consideration. We may disclose, and in the preceding 12 months we may have disclosed, the categories of personal information described in the section titled "WHAT PERSONAL INFORMATION DOES BOOKING UNION COLLECT?" to third parties for a business purpose, including the following categories of third parties:


  • Our Affiliates and Related Entities: We may disclose your personal information to our affiliates and related entities in order to provide you with access to and use of the Booking Union Sites, to provide services, products or offerings, to administer our relationship with you (e.g., invoicing, marketing, IT/infrastructure, customer or supplier intake/management), or otherwise as necessary for the business purposes described in the subsection above.

  • Third-Party Service Providers: We may disclose your personal information to third party Service Providers which provide services or functions for us or on our behalf or which otherwise assist us in providing the Booking Union Sites, or our services, products or offerings.

  • Third parties relating to logistics services: In connection with the performance of logistics services, we may disclose personal information to third parties, such as Booking Union's customers and their agents/representatives, carriers and other logistics service providers, and government entities.

  • Third parties relating to compliance and legal reasons, security, risk management, and protection: We may disclose your personal information to law enforcement, regulators, other government authorities or officials, courts and other tribunals, our professional advisors (such as lawyers, accountants, and auditors), and other recipients of mandatory disclosures and legal claims.

  • Third parties in connection with business transactions: We may disclose and/or transfer your personal information in connection with a potential or actual sale, merger, acquisition, bankruptcy or other transaction in which an affiliate or third party acquires all or any part of our businesses and/or assets.

  • Other third parties: We may disclose your personal information to other third parties with your consent, as described to you at the time of collection of your personal information, or as otherwise permitted or required by applicable law.


HOW LONG DOES BOOKING UNION RETAIN PERSONAL INFORMATION?

We will retain your personal information for as long as reasonably necessary to fulfill the purposes for which we collected it or other compatible purposes set forth in this Privacy Policy (or that we have otherwise disclosed), unless a longer retention period is required or permitted by law or regulation, with such retention being consistent with our retention policies. When determining our retention policies, we take into account various criteria depending upon the type of information, such as obligations under applicable laws and regulations to retain the information for a certain period of time, statute of limitations under applicable law(s), the nature, amount and/or sensitivity of the information, the length of time required to provide the service, product or offering, and/or ongoing needs for the information for legal and other business purposes. When the applicable retention period for personal information has expired, we either (i) destroy such personal information or (ii) if permitted by applicable law, may anonymize such personal information, in accordance with our policies and/or practices relating to retention and destruction of personal information.


HOW DOES BOOKING UNION PROTECT PERSONAL INFORMATION?

Booking Union uses various administrative, technological, and/or physical security measures to help protect the personal information collected. We have implemented policies and/or practices relating to information security and to define roles and responsibilities of certain employees to help protect the personal information we collect throughout its life cycle, including certain role-based access controls and retention periods depending upon the nature of the personal information; and we have implemented cybersecurity awareness training for our employees.

Please note that, in the event you set up an account with us and choose a user id and/or password, it is your responsibility to:


  • Control access to and use of your user account, ensuring that no unauthorized person shall have access to your account, user id, or password

  • Promptly inform Booking Union of any need to deactivate or change your user id and/or password

  • Change your password frequently to increase security

  • Comply with all of Booking Union's instructions for using, maintaining, or correcting your account

HOW DO I EXERCISE MY RIGHTS REGARDING PERSONAL INFORMATION?

Your jurisdiction may provide individuals with certain rights relative to their personal information, as defined by applicable law. For example, subject to applicable law and depending upon your jurisdiction, you may have the right to request access to and receive details about the personal information we maintain about you, update and correct inaccuracies in your personal information, obtain a portable copy of the personal information we maintain about you, or have your personal information deleted, as appropriate. These rights may be limited in some circumstances by local law.

Under some jurisdictions, subject to certain exceptions and applicable law, your privacy rights in relation to personal information about you may include:

DELETION REQUEST RIGHTS

For California, Texas, and Nebraska consumers: As more particularly described in the applicable law in your jurisdiction, and subject to certain exceptions, you have the right to request that we delete any of your personal information that we collected about you and retained. If applicable, once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception under applicable law applies.


CORRECTION REQUEST RIGHTS

For California, Texas, and Nebraska consumers: As more particularly described in the applicable law in your jurisdiction, and subject to certain exceptions, you have the right to request that we correct inaccurate personal information that we may have received or maintain about you. In lieu of correcting the personal information, Booking Union may delete the personal information if the deletion of the personal information does not negatively impact you, or if you consent to the deletion.


NON-DISCRIMINATION RIGHTS

For California, Texas, and Nebraska consumers: We will not discriminate against you for exercising any of your rights under the CCPA, TDPSA or NDPA (unless permitted by applicable law), such as by:


  • Denying you goods or services

  • Charging you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties

  • Providing you a different level or quality of goods or services

  • Suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services


ADDITIONAL NOTICE FOR INTERNATIONAL RESIDENTS (OUTSIDE OF THE U.S.)

This section of the Privacy Policy applies solely to persons outside of the United States ("you"). Booking Union is located in the United States, and Booking Union operates the Booking Union Sites, in whole or in part, in the United States. Please note that personal information provided to us will be collected, processed and/or stored in the United States and/or other jurisdictions outside of your jurisdiction where you reside, subject to applicable laws and regulations in the United States (or such other jurisdictions) that may not provide the same level of protection of personal information as those privacy laws in your jurisdiction.


By using a Booking Union Site and/or submitting personal information to us, you agree to have your personal information collected, processed and stored in the United States, pursuant to the applicable laws and regulations in the United States, and/or in any other jurisdiction (pursuant to its laws and regulations) where we, our service providers, or other recipients of personal information disclosures mentioned in this Privacy Policy may process your personal information, all in accordance with this Privacy Policy.

Embedded Web Links:

Links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link. The tracking is accomplished through a redirection system. The redirection system allows us to understand how the link is being used by email recipients. Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the personal information that we hold about you. This data is used to improve our service to you and to help us understand the performance of our marketing.

ARE THE BOOKING UNION SITES INTENDED FOR CHILDREN?

No, the Booking Union Sites are not intended for children. If you are under the age of 18, please do not use the Booking Union Sites. Booking Union does not knowingly solicit or collect personal information (as defined by applicable law) from children under the age of 13. TERMS FOR TEXT/SMS MESSAGING TO MOTOR CARRIERS AND POTENTIAL EMPLOYEES/JOB APPLICANTS

We may communicate via text or SMS messaging with (1) potential employees, including through use of third party service providers (the “Potential Jobs Program”), and (2) this independently contracted motor carriers and other logistics service providers.


This Privacy Policy applies to your participation in the Program, and by participating in the Program you: agree in connection with the Potential Jobs Program (relating to potential employment opportunities) to receive mobile messages from Booking Union, including from any third party partner reaching out to you on Booking Union’s behalf, including, without limitation, messages via text/SMS and/or prerecorded mobile messages, at the phone number you have provided or at the phone number that someone might have provided to us on your behalf after determining your potential interest in employment with Booking Union, in connection with potential employment opportunities with Booking Union.

If you do not wish to continue participating in the respective Program or no longer agree to this Privacy Policy, you agree to reply “STOP” to any mobile message sent as part of the respective Program in order to opt out of the respective Program with respect to messages from the associated phone number used on our behalf for the communication(s) (“associated phone number”). You may receive an additional mobile message confirming your decision to opt out. If you opt-in again for the respective Program with respect to the associated phone number after replying “STOP”, we will resume sending messages from the associated phone number to the phone number associated with your opt-in (with participation in the Program once again being subject to this Privacy Policy). The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us and/or with our third-party service providers on our behalf (in the case of the Potential Jobs Program, as applicable). Message frequency varies. The Program will send SMS TMs (terminating messages) if your mobile device does not support MMS messaging.


The Program is offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with the Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control. In addition, wireless carriers are not liable for delayed or undelivered mobile messages.
